If he wanted her dead he could have found another way with no witnesses. He very well may have been sleeping and he jerked awake. He was trying to keep their friend from being involved, his lawyer mind was working. I think this was a horrible accident. He probably fell asleep and they had been drinking, when he asked for the gun he put his hand on it and fell back asleep he probably jumped awake because he was half awake and half asleep and the spasm caused him to make a firm pull on the trigger. He shouldn't have had his finger on it. I think they are reaching here.
