  1. A Questa teen charged last summer with second-degree murder on suspicion of shooting and killing a 13-year-old girl at his family's home pleaded guilty on Thursday (Aug. 15) to a single count of tampering with evidence, a third-degree felony.

    Porfirio Brown was 14 when charged with murder in the fatal shooting of 13-year-old Questa teen Amber Archuleta on July 28, 2023, but a trial held in his case this past February ended in a hung jury.

    At Thursday's plea conference, Brown stood alongside his attorneys, Lizzy Bunker and David Foster, as he pleaded guilty to the downgraded charge, which stemmed from the allegation he moved Archuleta's body and attempted to clean the crime scene before police arrived. Glenda Archuleta, the aunt of the teen girl who was killed, addressed the court after Brown formally accepted the plea agreement.

    "Your wicked actions have affected the entire community of Questa," she said.

    Bunker objected to Archuleta's comments, calling them "wildly inappropriate" in light of the fact that Brown was not pleading guilty to killing Archuleta.

    "This is one of the most heartbreaking cases that I've seen," Judge Chavez said.

    During Brown's trial in February, Bunker argued that multiple errors had been made during the course of the investigation into Archuleta's death, including Questa Police officers' failure to secure the crime scene, allowing two other teen witnesses to Archuleta's death to enter and exit the home at will. The firearm used to kill Archuleta, alleged to belong to Brown's father, William Brown, was also never recovered.Following Archuleta's death, the elder Brown became the first person in New Mexico to be charged with negligently making a firearm accessible to a minor, a fourth-degree felony created under the Bennie Hargrove Gun Safety Act just month's before Archuleta's death. Brown was found not guilty at a trial in 8th Judicial District Court in June.

    According to the terms of the plea agreement, Brown faces up to one year of probation. A sentencing hearing in his case will be held at a later date.

  4. There was a mistrial and he ended up pleading guilty only to tampering with evidence. There’s a chance he will only get a year probation when it’s all said and done. DISGUSTING!

  5. This 14 yr old boy was given a year of probation for tampering with evidence. All other charges were dropped. The father was found not guilty regarding responsibility for the guns! No justice or accountability! Irresponsible, disgusting and sad!

  6. What confuses me about the shooter’s dad talking about the victim is that he says “she’s- the body’s in the back”. He starts by personalising the victim and then uses distancing language, in that order. Why would he correct himself?

  8. UPDATE: Porfirio Brown (the alleged shooter) went on trial for second-degree murder and it ended in a hung jury. He then accepted a plea deal where he pleaded guilty to a single count of tampering with evidence, a third-degree felony and is expected to serve a year of probation. Prosecutors have agreed to drop the murder charge against him.

    Brown's father, WIlliam Brown, was charged with negligently making a firearm accessible to a minor, a fourth-degree felony but found not guilty.

    The family of the victim, Amber Archuleta, stated:

    "[I]t is impossible to ignore the profound failures of the judicial system and law enforcement in this case. The mishandling of the crime scene, and the fact that the shooter and his family were allowed to destroy critical evidence and hide the weapon used to end Amber’s life, represents a grave injustice not only to our family but to the entire community of Questa, New Mexico.

    "Then for the shooter’s family to mock the situation and say they were going to have a party at the house where Amber was murdered on the day she was murdered explains everything you need to know about these horrible people…

  9. When i was 14, i cried for days because my hamster died of old age. This kid got some issues and its all the dads fault. Im currently pregnant with my first girl and thinking of losing her kills me. May that family find some sort of peace.

  10. kid eventually pleaded guilty to single count of tampering with evidence, a third-degree felony. the father was charged with negligently making a firearm accessible to a minor, a fourth-degree felony, and found not guilty at trial. lol, smfh.

  11. Again parents should be charged for not securing there guns in there house !!! It’s the law. This is not a cartoon. It’s real life !!!
