31. How do they not have evidence? Did they not draw blood at the station? Why not? It's fine that he refuses the breathalyzer, but they have his smell of alcohol, his erratic driving, plus the meh FST. He wasn't clearly drunk, but he didn't do great. Hard to tell if he's drunk or just clumsy and stubborn. He could have just turned down the FST AND the breathalyzer and not asked for preferential treatment and all they'd have on him would be the officer's olfactory perception. Very strangely handled case.
