    Whether it's a sidewalk or city hall – both are "taxpayer funded" property – thus both are public property. If you want to talk about public forum doctrine, then there is a conversation to be had. Obviously a public sidewalk has the greatest protections as a quintessential (traditional) public forum. If you want to talk about a limited public forum, then yes, they may make some rules, but those face strict scrutiny. They must be narrowly tailored and serve to achieve compelling government interest in a way that is the least restrictive. Since he's outside the building and not creating a disturbance, and it's open to the public, and it's during hours that it's open to the public, it would be difficult to convince a court that he didn't have a right to be where he was, doing what he was doing.

    If this were a nonpublic forum, like a school or a military base, then, and only then, would having him leave be a lawful command – but this wasn't.

    If only people would remove their heads from their nether regions, actually understand the law, and ultimately respect the rights of others, this wouldn't be an issue.

    It wasn't even a legal trespass in the first place.

    Furthermore, trespass law requires that a person REMAIN on the property

    Georgia Code Title 16. Crimes and Offenses § 16-7-21

    (3) Remains upon the land or premises of another person or within the vehicle, railroad car, aircraft, or watercraft of another person after receiving notice from the owner, rightful occupant, or, upon proper identification, an authorized representative of the owner or rightful occupant to depart.

    When he asked if he was being trespassed, he attempted to leave, which was his legal right to do. It doesn't become criminal unless he refuses to leave or returns to the property after being given notice.

    This means it is still a civil trespass at that point – and since it was not yet a criminal act, any detaining of his person would be illegal. He had no legal obligation to give his ID in any way, shape, or form. The demand for ID was NOT a lawful order.

    "Playing the game" is an act of retaliation by your unprofessional officer. If this is what people can expect from your officers, you continue to create that gap between law enforcement and the citizenry you are supposed to serve.

    Sadly, it will take yet another lawsuit at the cost of the taxpayer, where the officer will be "told" he was incorrect, but it costs him nothing, and he will continue to be a bad officer who violates the rights of others.

  2. You’d think judges would start getting sick of seeing these cases and perhaps start coming down a little harder on these officers making illegal arrests. But I guess they’re getting paid regardless so what do they care.

  3. Whats up with that belly? He could not chase a criminal if he had to. Tax payers must fund his health care during and in retirement for excessive BMI. Heart disease, diabetes, and therapy for his anger and aggressive attitude will cost us all.
