In the country where I live he would be at blame. No matter what he said as he was behind the bus. Its you responsibility to keep enough distance from the car in front and check your speed etc. In the case the bus. Since the cab itself burnt down to the ground it would be near impossible to tell if brake fluid lines were dodgy etc.
