-Sgt. Miller of the Hamilton County Sheriff’s Office responds to a swamp-area pursuit after a driver hits a patrol car, wrecks his truck, and both suspects are caught muddy and exhausted in the woods.

  2. In the United States, a traffic stop constitutes a seizure under the Fourth Amendment and must be limited in scope and duration to its original purpose. When a driver is lawfully stopped for a minor traffic infraction, such as a seatbelt violation, law enforcement officers are permitted to carry out tasks reasonably related to that violation, including verifying identification, checking registration and insurance, running warrant checks, and issuing a citation or warning.

    Once these tasks are completed, the constitutional justification for the stop ends. Law enforcement may not extend the duration of the stop absent independent reasonable suspicion of additional criminal activity. This principle was clearly established by the United States Supreme Court in Rodriguez v. United States (2015), which held that even a brief extension of a traffic stop to conduct a K-9 sniff, without reasonable suspicion, violates the Fourth Amendment.

    A canine sniff conducted during an unlawfully prolonged stop is considered constitutionally tainted. Although a K-9 sniff of a vehicle’s exterior is not itself classified as a search, its legality is contingent upon occurring within the time reasonably required to complete the original traffic stop. If officers delay the conclusion of the stop solely to wait for a drug-detection dog, the seizure becomes unlawful.

    Furthermore, any probable cause arising from a dog’s alert during an unlawfully extended stop is invalid, as it is the product of an unconstitutional detention. Evidence discovered as a result of such a search is subject to suppression under the exclusionary rule.

    Therefore, when law enforcement prolongs a traffic stop beyond its original mission without articulable and independent reasonable suspicion, any subsequent canine sniff, search, and arrest violate Fourth Amendment protections. Courts assess these violations by examining objective factors such as body-camera footage, dispatch records, and the sequence of events to determine whether the stop was impermissibly extended.

They Do Outstanding Jobs Most of the time, But When they pulled over that dude for Not wearing his seatbelt, They had that dog alert drugs in his car and the Only thing they found was an Old little baggie that had a Microscopic amount of residue in it. And They actually Locked Him up. That was Ridiculous. SMH…..
