Two California newlyweds celebrating their honeymoon in Hawaii were allegedly abandoned and left stranded in the ocean by a snorkeling tour company in 2021. The couple filed a $5 million lawsuit against the Maui-based company, claiming the tour guides did three head counts before setting sail back to land. The Law&Crime Daily team has the latest on this case.

The movie “Open Water†is a terrifying film that is nearly spot on with this story, except they weren’t as fortunate as this couple.
Diving companies everywhere should be using the tag in tag out system. Every swimmer has a numbered band around the arm or wherever as they suit up to get in the water. Give it back when you get out. Very basic and the count can't be missed….

I'm all for a lawsuit, but they should have been able to swim half a mile. They both look pretty healthy and young. I once pulled an out of gas jet ski three miles when I was 17. Was it very difficult? Yes. Was it doable? Absolutely.
It's serious if they can't swim but half a mile is not very far to swim to shore if it's a normal sunny day and it seems like they were within view of the boat and the shore at all times, right? The way all the headlines phrase it makes it seem like they were dumped in the middle of the ocean but that doesn't seem to be the case.
Don't they take names/lists of who's boarding the boat? They will lose this lawsuit and for good reason

The couple being left at sea reminds me of the film "Open Water," which itself was loosely based on a real life couple who was stranded at sea during a scuba trip. Luckily, things turned out much better for these newlyweds.
I don't understand why these companies don't do a roll call as opposed to a headcount. This is sort of the same thing happened in Home Alone.
They can make a movie about their story.
They don't deserve anything other than to be publicly shamed
Ironically on a trip to Cancun I begged the guide to take the whiners back to the beach including my wife and then come back for me a they wouldn't.
That is such an important job, people's lives could be at stake. How do you forget to people. Two whole, full grown, human beings. This is unbelievable. I guess I'm crossing snorkeling off my list.
A headcount is not enough. They should read off names.
I did this tour a while back with my daughter, who was around 5-6 at the time. My daughter was scared when we first got in the water, but slowly started to calm down and really enjoy it. About the time she was really comfortable and having fun, it was time to go to the next spot. We unfortunately were near some of the staff and overheard one say there was too many sharks spotted and maybe they should go back to our original spot. The other crew members said "oh they'll be fine and if anything, we'll have a lighter load going back!" Um, no! We obviously didn't get off the boat. And within 10 minutes, people were scattering to get back on the boat due to sharks rapidly moving in to our area.
Heading back to Maui this fall and this is at the top of our "absolutely NOT doing" list!
A RF wrist band you scan before heading back sounds a lot cheaper than 5 million dollars.

I work in a refinery.. we use a key and lock system where a lock is put on a box, containing something that only a operator can access… in this case a boat operator…. but each person, or worker keeps their key on their person… when each lock is unlocked by the individuals, it can just about reassure that all people have been accounted for… and what I mentioned is for the refinery…. looks like it needs to be implemented in these situations as well
This happened to my wife and I during our honeymoon in MX. We took off all our personal belongings on the boat, got into the water and they motored away.
After an hour they came back with our belongings. Guessing they need a little time to copy our personal information.
That one couple that died like this left a note on the dive board that could of been them
"Im sure they didn't mean to leave them there" get this woman off TV.
Just like the movie Open Water that claims that that happens often people being left out there accidentally and die.

Let me say this, I've done the snorkeling trip in Maui as well years ago. The first thing they go over when you get to your dive spot is, stay together and don't' wonder off…..Plus the fact that there are Silver Tip Sharks around as well. I don't blame the operators entirely on this….
