  1. 1. It is in fact legal to yell "FIRE" in a crowded theatre. It has been definitively ruled on. 2. When the judge said that this was his consequence for using his right she gave him massive room for appeal. The mooning was an easy indecency, but irrelevant to the initial charge. I would need much more information on the applicability of time/space/manner considerations. Specifically, if others have angrily and rudely decried Christianity outside of churches and been released on constitutional grounds (has happened many times) then equal treatment becomes very relevant. Further to that, if the defendant truly believed he was within his rights, it argues against intent. And might (likely not) reach the level of injustice necessary to make a solid 1A in the mooning.
