I met with a class of high school seniors in Washington DC via Zoom yesterday, who had questions about qualified immunity and about their rights are when interacting with police. It was a fantastic experience and it got me to thinking that every kid should know this information before graduating high school. Though most people have no idea what it really is….

What is Qualified Immunity?

  1. Institute for Justice — has a very good video on YouTube — titled ( Qualified Immunity Protects THE FBI ? )
    Video run time 34:27
I recommend all citizens view this video also, and if you can donate $20, it will help citizens, who have had their civil rights assaulted by either government ignorance or government criminality

  2. Rick Sturdevant in San Diego, California is thankful and supports Attorneys like John H Bryan Esq AND Attorney John White's channel ( Southern Draw Law ) — Attorney Steve Lahto ( Lahto's Law ), and of course Institute of Justice, for their continuing efforts to infom and educate American Society on the complicated laws and Constitutional Civil Rights that — law enforcement, the court system, and other government officials and agencies continue to not enforce, not maintain, nor protect.

To be fair in my opinion : some government employees/actors do follow the laws they take an oath to maintain and protect — but, too many, ignorant, corrupt and criminal cops/government employees Do Not execute the oath they promise to uphold.

  3. Also : we should send notifications to Constitutional Attorney John H Bryan Esq. For his informative and educational PSA on why and how SUPREME COURT ACTIVISM has failed and crippled, the American Justice System. No doubt this particular failed decision has caused many American Citizens to distrust our justice system.

  4. So, there is actually no "objective" standard for qualified immunity. Even with constitutional rights violations RECORDED, it is a "he said, he said" standard, and the one with the badge is beLIEved.
I'm really struggling with seeing a police state being built by "judicial activism."

  5. My answer: A legal principle created whole cloth by the corrupt judiciary to protect treasonous, corrupt, rights violating cops from civil accountability.

Let's see how accurate my definition is.

Edit: If the principle of "fair notice" is such a good legal principle, why doesn't it seem to ever apply to citizens?

  6. Thank you for this and your other videos. Have you ever done a video about officer discretion? Seems if they just gave you a ticket when you were speeding and left you alone if you haven’t committed a crime, we’d be in a better place.

  7. I'm curious about repeat offenders. If qualified immunity is granted in one case, but the public official reoffends, violating the same constitutional right, does that change whether or not qualified immunity can be granted?

In other words, do the definitions of "reasonable official" and "on notice" change depending upon whether or not the official has been taken to court over the constitutional right in question before?
