It’s really not that complicated.

When do police have to advise you of Miranda warnings? When do they NOT have to read you Miranda warnings? When can they NOT interrogate you?? It’s sort of like 6 minute abs…..

  1. THE RIGHT TO PLEAD THE FIRST AMENDMENT
The right of freedom of thought . . . as guaranteed by the Constitution against State action includes both the right to speak freely and THE RIGHT TO REFRAIN FROM SPEAKING AT ALL . . . .
    West Virginia State Board of Education v. Barnette, 319 U.S. 624 (1943)

  2. These what to do when talking to the police videos always makes me think of when a person tries to cite personal rights or the legal code the cops always ask "What are you a lawyer? Did you go to law school? Did you watch some YouTube videos? You think you know the law better than me?"

  3. All of us have our Miranda rights, which are inalienable. It's foolish that we can lose those rights. Thanks to SCOTUS, those rights have become privileges that can be revoked. The lawyer is right. The state can and will revoke your Miranda rights.

  4. When talking to cops, you have to understand why they are called pigs. They arr pig-headed, and like a rapist, they do not understand that no means no. So when you say "I don't answer questions" be prepared to repeat it to them 1,000 times, literallly.

  5. How to talk to a police without a lawyer:
step 1 have police within talking distance
    step 2 don't have a lawyer present
Step 3 start talking to police
Step 4 u have now fucked yourself

(there absolutely is no benefit from talking to police guilty or not. Just dont)

  6. Not so easy-peasy. If you are not being recorded when you demand a lawyer for all questioning, then you did not request a lawyer for questioning. Police are trained to lie to suspects, and I have met many that are 100% willing to lie to earn their next raise. If you are not in custody, and the interrogation is not being recorded, it's up to the cop to decide if he wants to report that you demanded a lawyer. If the cop lies about your lawyer request, then at the very least they can use your refusal to answer questions as evidence of guilt in court (Salinas v. Texas). Bottom line is always record all police contact when you are not in custody, or they can and will say whatever they want about what was said, and the judge/jury will believe them over you nearly 100% of the time.

  7. I've seen all the rules from above being broken yet people are still getting put away. I seen this on the first 48 myself. They interrogated a guy for more than 8 hours then switched detectives. The detective played the simple minded nice guy and got the guy to confess.. They treated this detective like a super hero and bought him an expensive cake. I guess maybe the confession was valid but we are talking about an edited tv show so who knows. Also I do not think interrogations should turn into computations. What do they think could happen. Also the people themselves need to smarten up. If your on a jury it's your responsibility to make sure or rights were met. If not you are the bigger problem.
