‘He Has a Rifle’: Armed Suspect Shot Through Windshield by New Mexico Cops

Bodycam footage shows a close call between New Mexico police and an armed suspect on March 28. The Española Police Department said bystanders called 911 about a man “slumped over” in his truck while parked on the wrong side of the road. Fifty-six-year-old Hilario Baca allegedly brandished a rifle within seconds of officers arriving, leading to a non-fatal shooting. Baca now faces a single count of aggravated assault upon a peace officer. The Law&Crime Network’s Sierra Gillespie breaks it down.

  1. He was also parked in front of a bank.

"State Police agents learned that just before 7:00 p.m., EPD officers received a report of a Ford F-150 parked in the road, blocking traffic at 322 North Riverside Drive, in front of Century Bank.

Officers arrived to find the F-150 facing north in the southbound lanes, blocking traffic. The sole occupant, Hilario Baca, 56, of Velarde, was in the driver’s seat armed with a rifle. As EPD officers approached the vehicle, Baca raised the rifle and pointed it at an EPD officer. The officers commanded Baca to drop the weapon, but he continued to raise it toward the officer."

This is why they need to be carrying with one in the chamber. This officer didnt load one into the chamber until after the altercation and exchange of fire. Poor readiness and was lucky he had a partner with him.

  3. In Ga there would not be any question on it being justicmfoed or not. The OCGA plainly defines wg
when an officer can use excessive force. And everytime a cqse comes up with a outcome that isnt defined in the staye constitution tbey amend it. Theres so many amendments you probally cant find a loop hole

  4. My question is with the officer that they have most of the body cam footage of. Why is he racking his slide? Are you telling me this officer was rolling around without one in the chamber? If the suspect had better positioning, he definitely would have shot this officer before he could shoot him. I watched it back multiple times and nothing comes out of his service pistol when he racks his pistol. Am I seeing this wrong or was this officer unprepared for a deadly threat? Am I missing something?

  5. Just another day in America where life is cheap, which is odd for a country with such a 'pro-life' lobby, eh? Gosh, America is such an uncivilised mess!

  6. Ok, that officer that nonchalantly walked up to the truck after an officer told him he had a rifle, then turns and runs like a coward when said rifle was pointed at his fellow officers, should've been born a female. He had a clear shot and chose to turn his back on the threat, never turn your back to the threat

  7. I would feel really unfortunately working with the initial officer. How are you on patrol without being loaded for duty? Pretty sure that's not the policy of the agency and if it is they need to change it and provide corrective training for the officer.
