The First Amendment is FORUM driven.
With 'traditional public forums' being WHERE you have a RIGHT TO RECORD.
And 'designated forums' being WHERE you have a RIGHT TO RECORD – BUT – under restrictions that you not disrupt the orderly business of the forum.
And last, the 'nonpublic forum' WHERE you have NO RIGHT to RECORD
but may be permitted to at the discretion of the owner.
AUDITORS should ONLY be testing in 'traditional pubic forums'
or designated forums that allow public input.
THOSE are the ONLY PLACES where you car Record AS A MATTER OF RIGHT.
Inside Police stations, courtrooms, etc. is by PRIVILEGE. And when you abuse privilege, it is usually taken away.
First Amendment activity (like taking pictures) in public is strongly protected in traditional public forums and designated forums.
"traditional public forums" include things like public parks, streets, and sidewalks ALONG SIDE THE STREETS, etc.
"designated forums" include things like school board meetings where public input is invited as part of the meeting.
Everything is nonpublic forum and often(but not everywhere) including court rooms, courthouses, PARKING LOTS and lobbies of agencies, etc. and that can also include dedicated sidewalks between the street and the building.
There only has to be a rational basis to restrict filming in nonpublic forums.
All the agency has to do is enact a "NO RECORDING DEVICES ALLOWED" policy and put up signage posted on the doors or between the street and the buildings — AND WHEN THEY DO — the public's PRIVILEGE to film FROM those areas will likely be GONE forever.
