Intoxication is intoxication. If it results in the impairment of safe operation of a motor vehicle it is not in any way acceptable. It doesn't matter if it was tobacco or vodka or aspirin.

Personally I don't think he was legally drunk, but I think he was not sober. Whether the cause of his slight stiff leg walking was an injury, or a prescription pain killer, I do think he was on something besides water. He didn't say much to get a good read on word slurring, but he didn't seem sober to me.
