1. You are wrong. The officer has the legal right to ask anything he likes, just as we all do. That is part of the first amendment. What he does not have is the authority to force you to answer or present the ID he requested without the proper circumstances.

11. The problem is they have every right to ASK, and citizens have every right to decline (if there is no RAS or if they are not in a stop and ID state). But, if a citizen ever attempts to exercise their rights, the same officer will be condescending or even arrogant asking the citizen "if they are a lawyer" to infer that they don't know the law (or their rights).

24. you know…I hear it all the time…people say "cops have a legal right to ask for ID, even if they can't demand it". But a cop "asking" is no different than a normal person's (while wearing body armour and carrying weapons) demanding.

    Now…if by law there is a requirement to show ID because you are lawfully detained (and that state says you must if lawfully detained)..then ask away. But if there is no such requirement then it's a violation of a person's 4th amendment!

What this piece of trash just showed (by yelling at someone) was that the “ask” from these badged idiots will often result in compliance but….with everything going on in the world today (in this day and age) every citizen knows that “ask” can immediately turn into arrest, elevated suspicion, being followed so that an officer can pull someone for the many minor infractions that everyone is susceptible to (especially them), a host of reasons to comply through coercion that is being seen by a large part of the population. The quiet and polite ask “in this day and age” comes with implied threats and he didn’t even achieve this.

    But I am glad he at least caught the process gap with a trespass. He understands without documentation their is no way to know if someone who is trespassed returns but missed the point that if someone leaves when they are told to it’s not a crime. But like most of these guys he will still miss the process gap about his own organization self investigating misdeeds.

    What he should ask himself is if ‘asking’ while yelling at someone with a badge and a gun is ever not carrying some form of implied threat.
