1. This isn't a "clueless" cop, it's an intentionally "malicious" cop. Both the Lt and the Sgt know exactly what they were doing was illegal, and they did it anyway because they never suspected they'd be deposed in a lawsuit. Even after this humiliating performance, these cops will do nothing different at all. And if they get caught again, they'll just sit through another deposition and lie again. This is what "qualified immunity" looks like.

2. The attny SHOULD have asked what the PROBABLE CAUSE for the detention was. The pig REQUIRES PROBABLE CAUSE OF CRIME to "detain". Fasto didn't have it. Hey Cop, is holding a camera in an of itself a crime? NO. Is standing outside a public building in an of itself a crime? NO. Is taking a picture of a public building in an of itself a crime? NO. Is holding a camera in an of itself a crime? NO. Is taking a picture of a public building in and of itself suspicious? NO. Prior to the detention did you observe the suspect holding a weapon? NO. Prior tot the detention did you observe the suspect wearing cammo or military garb? NO. Are people who appear to be engaged in suspicious activity without being informed they're under arrest mandated or required to tell you their name? NO. Is it a fact you could use any of the information provided by a suspect against them? YES. Do suspects being detained have the right to remain silent? YES. Are you authorized to punish or retaliate against one who elects not forfeit their right to remain silent? NO. Was my client required or mandated to cooperate by forfeiting her right to remain silent and tell you her name? NO. Do you know the definition of punitive? YES. Would you consider your taking my client's camera without a warrant or other court order having not informed her she was under arrest and why punitive? [ ] Would you agree that suspicious conduct is not necessarily criminal conduct? [ ] For the record state the conduct to which you subjected my client to a warrantless arrest? Could you have gone inside the building and appeared before an officer authorized to administer oaths and issue warrants to get a warrant for the suspicious activity you observed? [ ] The pig's cooked bacon and he cooked himself! STUDY LAW! KNOWLEDGE IS POWER WHEN PROPERLY APPLIED!

6. OMG…this LT is typical of all LEOs unfortunately. These are my observations about the LT based on this deposition:
   Believes he can subjectively determine suspicion of a subject and detain subject.
   Only vaguely understands 4th amendment: Only element he knows need PC for search/seizure
   Doesn't understand the need for lawful basis to ID a subject.
   Doesn't understand that he must have RAS of a crime before detainment/arrest.
   Doesn't understand difference between detainment and arrest.
   Thinks he can cuff someone solely for officer safety ( without RAS ).
   Can't say whether his detainment of victim was lawful.
   Doesn't know if there's a law governing when a subject can be lawfully ID'd.
   Doesn't know if an officer is legally allowed to delete pictures off of a subjects camera.
   Doesn't understand what "lawful" actually means.
   Thinks cuffing a subject is OK as long as officer safety is the reason.
   Doesn't know the Constitutional amendment that gives a citizen the right to counsel.
   Thinks he can detain anybody as long as he needs to do an investigation.
   Does NOT know Miranda rights.
   Does not understand that if a citizen requests a lawyer, the questioning has to stop.
   Doesn't know what RAS is.
   Doesn't understand what it means to charge someone with Obstruction.
   Does not seem to understand that the plain view doctrine applies to public photography.
   Thinks that if a citizen invokes his 5th amendment right the citizen is obstructing.
   Didn't even know what was in the judges order at time of arrest.

   Generally the LT doesn't seem to be very intelligent at all, certainly not enough to hold such a high rank and be in charge as it were. This LT is a danger to everyone he interacts with under color of law.
