Man Doesn’t Understand That Death Threats are a Felony

This video is self-explanatory. I recommend reading the police report excerpts included at the end, as they provide additional information on the incident.

It’s hard to understand how some people make it to adulthood without knowing that you can’t legally threaten to kill someone.

Kevin Lyle Daniel Jr. was charged with felony harassment on May 18, 2018. He entered into a stipulation agreeing that there exist facts sufficient to prove his guilt, and was approved for entry into a felony diversion program where prosecution of the felony would be deferred pending successful completion of the program. Daniel was fined $850, was required to perform 48 hours of community service, and was assigned 90 days of anger management classes. The court also issued a no firearms possession order and required that Daniel be assessed for alcohol problems, followed by 90 days of treatment.

On October 8, 2018 a court review found that Daniel had complied with program requirements. On May 24, 2019 a motion to dismiss was filed and granted. On that date the felony case was dismissed and closed. For a bit.

On July 30, 2019 the case was reopened, as Daniel’s attorney had filed a motion to seal the case record. One week ago, on August 16, 2019, a hearing was held on the motion to seal.

Denied.

*Regarding the audio and video quality: For some reason Bainbridge Island Police Department was still using first generation Axon body cameras as recently as June 2018.

  1. Update: On August 10, 2018 Kevin Lyle Daniel, Jr. was fired from his job as an investment advisor at Merrill Lynch, where he had been employed for 21 years. The termination was reported to FINRA as "Discharge – Conduct involving failure to timely disclose a reportable event." The reportable event, of course, was getting charged with felony harassment / threatening to kill. Actions have consequences.

  4. Idk.. seems like he did lose his temper.. needs some anger management.. possibly a little community service and/ or probation. A “good talking to” may not be enough. When the cops are talking to him you can tell he’s still trying to justify his actions. He may have had no intention of doing anything but! A little bit of probation or community service would let him review his actions and remember the consequences.

  14. Jesus Christ, what’s so offensive about being thought of as a swinger? It’s a good thing I’m not a cop because as soon as he said his cop brother had to kill a guy I’d have involuntarily blurted out “He was called a swinger too?”

I don't know which states this was but I actually seen a guy talk to a hitman (undercover), on camera about killing his wife but because he didn't act on it, there was nothing the police could do. Moving to a different state could be a dangerous thing if you don't understand the different laws.

The reason that cop said that was to try to TAKE that away from the man, so he let out a little more aggression to compensate for what the cop tried to make him feel like he DIDN'T achieve. Cops are sick ppl, I watch them try to manipulate ppl every day. But we all know that by now.
