  1. Accept the traffic citation regardless of what the offense is – you will have your day in court. The thing is, prior to that court date, make a motion for Discovery. This grants you access to any and all evidence that the state/ law enforcement department making the citation has. Just about 10 out of 10 times, they will have no evidence against you. However, you will likely have trouble in getting your motion for discovery – this is a blatant infringement of your Due Process so the entire thing can be thrown out before the court date based on that alone.

  2. Hahaha. In my state it’s easy. Question when the radar was calibrated. If the officer doesn’t know then he was incorrectly trained in its use. In TN it’s required biannually by the manufacturer. Some cities even require the officer to use the tuning forks pre shift and make them sign out that it was calibrated that way. So an officer stating IDK means he didn’t calibrate the radar pre shift so it’s most definitely not reading accurately. Also question the cosine angle the radar was used at. Even a moving palm tree in Florida can register over the speed limit when they are used incorrectly. Don’t let the government use you as revenue generation more so than they already do. 👍🏻
