California Cops Shoot Carjacking Suspect As He Grabs Airsoft Pistol in Waistband

Newark, California — On Thursday, April 13, 2023, officers from the Newark Police Department and Fremont Police Department were involved in an Officer-Involved-Shooting (OIS) in the 39000 block of Cedar Boulevard. The suspect vehicle was initially carjacked on February 14, 2023, at approximately 8:00 a.m. in the 5700 block of Thornton Avenue in Newark. The victim was dropping their child off for school when a suspect approached the vehicle armed with a knife. A teenage victim who was inside the vehicle was forced out at knife point and the suspect fled the scene in the vehicle.

On Thursday, April 13, 2023, at approximately 3:20 p.m. the suspect returned to Newark in the vehicle that was carjacked on February 14, 2023. The suspect and an associate were located with the vehicle at 4:46 p.m. and a high-risk stop was conducted by officers. While attempting to take the suspect into custody, officers observed what appeared to be a firearm in the suspect’s waistband. The suspect ignored officers’ commands, withdrew the perceived firearm, and an OIS occurred. Officers immediately rendered aid and summoned emergency medical personnel, but the suspect did not survive. The second suspect was transported to a local area hospital and was released shortly after with minor injuries. The firearm was later determined to be a full metal airsoft replica of a Berretta M9 pistol. The suspect was later identefied as 19-year-old Elmer Lopez-Castaneda, resident of Newark.

  1. I mean, it's anybody's guess what he was going to try to do with an airsoft pistol, but they told him to drop to the ground and he drew it. People try to fight despite being outnumbered and outgunned all the time. Justified.

  2. Officers shouldn’t have to walk up to someone with a gun to ask if it’s real or fake. This was definitely the suspects fault for getting himself killed, reaching for his waistband while knowing there’s any type of gun, real or fake while police are yelling to keep your hands up and they’re pointing their guns. Not smart.

  3. Thanks to these officers for ending his criminal career. 19 and stealing cars?! He probably just needed to get to school or something..

  4. Not justified. Dumb kid to be in a compromised situation, but based on this situation, the shooting wasn't called for.

  5. Strongly Disagree. After screaming "gun, gun" … the officer's follow-up command was "drop down to the ground now". I am pretty sure the suspect understood/was under the impression: "drop the gun now" vs. "go down on the ground now". The commands were bogus and bad English!!! Also, he rather slowly pulled the gun out. He definitely did not draw the gun to shoot.
    Too quick on the trigger and should have consequences for the trigger happy officer who’s English just sucks.

  6. I felt like it was unconscious muscle memory for him to pull his pants up before going to the ground. Which left him dead.

  7. Maybe if he didn’t steal cars with his boyfriends he be alive, hey boyfriends if you seeing this get a job and stop stealing people stuff or else your next!

  8. At least the suspect's buddy wasn't as stupid as he called out, "I'm not gonna f#@&ing move, I swear."
    I wonder if he managed to learned something watching his idiot friend get shot to death?

  9. Even if all he was doing was trying to get rid of the gun, it was a stupid idea to reach for it at all. Glad to officers were hurt.

  10. Good ol east bay. Not sure what this future astronaut was planning on doing after he drew his trusty air soft gun, but he got the help he needed regardless.

Not saying the shooting was not justified but at 1:51 the whole thing goes downhill when he yells "gun, gun drop down to the ground now drop it" [last word might be "it"?] in that kind of tense moment to me it looks like he's pulling it out of his waist to comply with the perceived command of "drop the gun to the ground".

  13. Does anyone think he was going to try to shoot the cops? Like for real do you think that he was grabbing his airsoft gun to fire at the police? I don't think that was his intention.
