The Austin Police Department released body cameras, dash cam, citizen phone recording video, maps, surveillance camera footage of 2 shootings incident that occurred on January 5, 2021, at approximately 12:34 a.m., the APD received a 911 call from an off-duty APD officer Gabriel Gutierrez who stated he was involved in a shooting incident that occurred. According to the off-duty officer Gabriel Gutierrez, he was driving in a neighborhood and when he turned southbound onto the 2500 block of Wickersham Lane, he noticed there was a car behind him. This car cut the officer off and once it pulled up along side his vehicle, the officer saw the driver point a gun at him. The officer fired at the suspect, and the vehicle continued to travel a short distance southbound on Wickersham Lane where it finally stopped against the curb. The officer stopped behind the suspect’s vehicle and called 911 to advise of the situation.
At 12:37 a.m., on-duty APD officers began to arrive on scene. This portion of the incident was captured on body worn camera. The footage shows the suspect vehicle stopped along the curb with the off-duty officer’s personal vehicle behind the suspect vehicle. A female subject can be seen lying on the ground just outside of the passenger side of the vehicle. The off-duty officer Gutierrez gave commands to the driver and as backup approached they continued giving commands to the driver who was now outside of his vehicle on the driver’s side.
Despite commands being continually given, the driver walked around the rear of the vehicle towards the passenger’s side of the vehicle. The driver opened what appears to be the back-passenger door of the vehicle. As the driver reached into the vehicle, the on-duty officer Luis Serrato fires at the driver which causes him to go down. The driver was pronounced deceased at the scene.
The female that was in the passenger seat of the vehicle was injured from gun fire. She was transported to the hospital and is reported to be in stable condition at the time of this release. An infant child was also discovered inside the vehicle. The child was not injured but was transported to the hospital with APD Victim Services as a precautionary measure. Investigators located a firearm at the scene of this incident.
As normal, both officers will be placed on paid Administrative Leave. The off-duty officer Gutierrez has been with the department for 5 years and the on-duty officer Luis Serrato has been with APD for 2 years.
APD will conduct two concurrent investigations into this incident; one is a criminal investigation by APD’s Special Investigation Unit in conjunction with the District Attorney’s Office, and the other is an administrative investigation that will be conducted by the APD Internal Affairs Unit with oversight from the Office of Police

Anyone count how many times he was shot in the back? I'm a dad too. I believe all men when dazed & confused instinctively would have went for their child or family members. It's what men do.
I Can't say who was right or wrong by what I watched. But I personally believe shooting a man in the back thats moving at a snail's pace should have been avoided at all cost!!
The first clue to the trigger happy officers should have been listening to the woman cry out for her baby, the second the obvious wobbles and confusion the Male had.

Something sounds hinky about the "road rage" incident Gutierrez described. If Gonzales cut Gutierrez off, normally it's the offended party (Gutierrez) who commits the road rage….

Idk I realize the cops are just doing their job here but clearly the man is stunned and can’t think or even walk correctly. They are shouting commands but he can’t seem to even understand what’s going on & walks to the back to check on his infant child and got gunned down for reaching for the child because the cops had no idea of what he was reaching for and if he could have more weapons. It just sucks once you realize he was just thinking of checking on his child & I have mixed emotions because obviously the fact of the matter is he shouldn’t have been being a dumb ass and wielding a gun to an off duty cop over traffic issues in the first place but it also sucks to know the two sides to everything and how that little kid must be traumatized as fuck now.
That’s a F’d up situation, I feel bad for the victims, his girl saw him get killed. No matter who’s at fault it’s just an awful situation

Of course Mama got a lawyer to sue the world for raising her son to shoot at police. The deceased endangered his girlfriend and her child by acting so recklessly. He is the sole responsibility for this incident.
Bad decisions on driver’s part. Good thing his attorney who wasn’t there knew what he was really doing. But 10 shots. Really? How about 4 or 5 instead and moving for cover to deliver another salvo? It’s rare I question use of force in these situations, but there are differences between 2, 5, 7, and 10 rounds, and we can’t let adrenaline pull the trigger.
I counted 10 rounds by that uniformed officer. Was that many really necessary?

The off-duty officer was looking for trouble. Get the plate numbers and call it in avoid at all costs. The other officer shot that man while he was trying to check on his family. Stupid situation all for nothing! Good job police you're really saving lives out here!
