Officer-Involved Shooting in Newton Division NRF014-20cr
The officer involved in the below incident has been identified as Police Officer II Toni McBride, Serial No. 43335, assigned to Newton Division patrol.

**The following information is based on a preliminary and ongoing investigation, which continues to evolve as investigators interview witnesses, review physical and electronic records, and analyze forensic evidence. The Department’s understanding of the facts and circumstances may change as additional evidence is collected and analyzed**

Los Angeles: Los Angeles Police Department’s (LAPD) Force Investigation Division is investigating an Officer-Involved-Shooting (OIS) that occurred late Wednesday afternoon, in Newton Division.

On April 22, 2020, around 5:37 p.m., LAPD, uniformed patrol officers, assigned to Newton Division, were responding to an unrelated call, when they came upon a multiple vehicle traffic collision at the intersection of San Pedro Street and 32nd Street. As the officers stopped to investigate, a radio call was broadcast of a man with a knife at the location. The officers then received information from citizens at scene, that the suspect who had caused the accident was armed with a knife. The officers did not immediately observe the suspect and one of the officers began rendering aid to a victim of the traffic collision. The partner officer observed the suspect (who has not yet been identified), armed with a knife. The suspect ignored the commands to drop the knife and advanced toward the officer, resulting in and OIS.

The suspect was struck by gunfire and fell to the ground, where he was taken into custody without further incident.

The Los Angeles Fire Department paramedics responded to the scene and determined the suspect deceased.

A folding utility-type knife was located at scene and recovered as evidence. Fortunately, no officers or innocent bystanders were injured during this incident.

LAPD’s specialized Force Investigation Division responded to the scene and interviewed witnesses and supervised the collection of evidence by the Forensic Science Division. A representative from the Office of the Inspector General responded and monitored the scene investigation.

The complete investigation will be reviewed by the Chief of Police, the Board of Police Commissioners, and the Office of the Inspector General to determine the thoroughness and accuracy of the investigation and whether the use of deadly force complied with LAPD’s policies and procedures. Additionally, representatives from the Los Angeles County District Attorney’s Office who responded to the scene will review the subsequent FID investigation; evidence collected and witness statements to determine if the force used by the officer was reasonable.

  11. I can't save the world alone but I thought I'd speak out on this. I express my opinion and without prejudice. Toni McBride comes across as an immature cop from other material i'd seen. She seemed to have one thing on her mind – Guns. I was left with an impression that she lives a fast life and that is maybe why she wanted to end this situation quickly. No pause for thought. People are not impressed with how many killing notches a cop has rather they want reassurance. That day Toni didn't give reassurance to anyone by killing Daniel Hernandez cold heartedly. Clearly he wasn't a danger to anyone but to himself. Daniel Hernandez can be seen from other video footage walking around in a daze. Toni had already been told Daniel Hernandez was hurting himself. He was displaying signs of mental disorder through drug use or personal reasons. We will never know. Instead of showing him compassion and talking him into being calm Toni helped him along with his suicide bid by pumping 6 bullets into him. Toni and her partner are then seen walking over to him while others cuffed him. What a big girl you are for killing him when he needed your help. You did not impress. Not a job well done. What happened to a taser option? Was Toni wearing a vest that could suppress a knife? Toni talks about being less lethal but her partner reminds Toni that she had already shot him. From watching other videos of her, she came across as a young immature girl itching to pull the trigger and to do it at speed. There is no doubt in my mind that she is an impressive shooter. For someone who is a sharp shooter why did Toni not aim for Daniel's legs? A lust for blood? Elsewhere alot of people talk about how attractive she is. However that thought fades away when you realise she displays no empathy and is ready to kill. Daniel Hernandez never had a chance. Toni never tried less lethal. There were so many other ways to bring this situation to a happy ending. When you watch some of her other videos on target practice she shows-off at how quick she is at pumping bullets into metal torsos. Thats the kind of action she only knows. Both her and her partner had guns trained on Daniel Hernandez from the start. She should have treated the situation as someone wanting to comit suicide. With two guns trained on him she could have afforded to spend time calming him instead of repeatedly shouting while pointing a gun at him to drop his knife. Daniel Hernandez focus was totally on her. Lets face it Daniel Hernandez wanted to be dead thats why I think he walks towards her so that she would shoot him. Instead of shouting at him to drop the knife, she could of lowered her own gun slowly and put it on the ground and told him to do the same knowing her partner's gun is all the time trained on him. Daniel Hernandez's total focus was on her so would have not paid any attention to the other gun pointing at him. Toni could of then spoken to him in a caring gentle voice that she knew he was upset about something and that she would help him. Toni could of talked about his family that would miss him if he was not there for them anymore. Instead it was easier for her to put her target practice skills into action and pump 6 bullets into him. Metal targets don't bleed or die but humans do. Also they had a car that they could of used to run him down. That would of hurt and incapacitated him but not necessary killed him. The crowd could of joined in to help by letting him know that they wanted him to live and that there is life worth living beyond this moment. There must of been people in the crowd that knew him that he could relate to. Toni needed to slow the situation. Pause for thought. After the first four bullets he wasnt trying to get up but wriggling around in pain. At that point he was in no state to do any harm. Toni, her partner and others could have overwhelmed him easily. Hypothetically they could have with guns trained on him walk towards him and put a foot on his wrist and pressed hard enough so that he realesed the knife then cuffed and helped him. In the UK with the threat over the cops must adminster first aid immediately until told by a medial professional they are taking over to give best survival chances. I didn't see Toni or anyone administering CPR after they cuffed him. Only a medical professional is allowed to cerifty if someone is dead therefore the cops in the UK would have to continue to administer life saving actions until medical professionals take over even if they believed the victim was deceased. As well as explaining the use of each bullet they used cops would certainly have to answer at court what action they took after the shooting to preserve the persons life. If the LAPD is serious about working with their community then descalation is the answer. Not collecting trophies. Toni needs to be proscuted. Hopeful she will have matured by the time she gets out and realise what she did. However I think this senseless excution will not bother her and her life will go on as if it was just another day at work. Taking a life is not impressive but saving one is. I believe if Toni was able to help this vulnerable man then on another day he may have thanked her for it. That would demonstrate so much more to a community. Does Toni really understand what it means to end someone's life and its impact on others? Maybe its time for LAPD cops to be ordered to administer life saving actions after shootings. A close-up of what they've done will make them think twice about using minimum force above lethal force. Toni McBride should be made to sit down and talk to Daniel Hernandez's family so that she can understand how her actions have impacted them and then maybe she will start to become a responsible adult. RIP Daniel Hernandez.

  13. She did a great job protecting the surrounding citizens after he deliberately crashed his truck into 4 cars. Those poor innocent people. Nobody talks about them only how all of a sudden the suspect is mentally unstable.? HE JUST CAUSED THE ACCIDENT WHILE ON METH AND OTHER DRUGS …THEN decided to go after a police officer with a DOUBLE BLADED KNIFE! Not the best choice when asked MULTIPLE TIMES to drop the knife. The officer didn’t cause his personal problems that day, he did.

  16. Firing "real" lethal ammo with all that people around was a really bad and dangerous idea. Wish she had a taser. That would have been more appropriate against a guy with a knife coming from few meters away. At least as a first response of course. BTW I don't feel bad for the guy, he played that game, he deserved the results…

  18. #DanielHernandez was too far away from McBride to present an imminent threat of harm. McBride was the only officer at the scene to fire a gun, and less-than-lethal options, like stun guns, were not employed.
