  1. States are so different when it comes to certain laws. When people refuse breathalyzer here in Colorado, they're license can be automatically suspended upon discretion of the officer. And after they refuse, they are placed into custody and are given one more option to either breathalyzer or blood draw by paramedics. If BOTH are refused, it's automatic DUI arrest and license is suspended.

  2. Here in Texas if you refuse you will be taken to the hospital for bloodwork…Texas doesn't mess around at all with DWI/DUI

  3. Please don't think you can refuse the Breathalyzer, FST and be let go. You have more options than perhaps the police will tell you, but getting away with DUI isn't one of them.

  4. I have to say I certainly don't feel bad about them getting a fu$%ing drunk driver off the road. That guy has NO fu$%ing business being on the road!

  5. OH NO, not again, this time the police clearly asks him if he will take the test, yes or no, and he caves. Breathalyzer tests can and should be refused, even if you are sober. Why? The field breathalyzer may not be calibrated. If you are chewing sugarless gum, that will trip a positive reading for alcohol. How is the breathalyzer "zeroed out" of any residual alcohol from any previous use?

    Once again. Field Sobriety Tests are Voluntary, never take them (most sober people can not pass the physical routines of these tests). Do NOT submit to the horizontal Nystagmus test (follow the pen with your eyes test) like this man did. Everything this man did, from excessive talking to taking tests, will surely incriminate him. By refusing to take the tests, he may have walked away with a ticket for whatever traffic violation was the cause for the stop.

    Oh, I forgot something about the roadside breathalyzer. Does it record time, date, location in a tamper proof manner? Does the officer just read the numbers and and of course, "accurately" record those numbers in the report? Place your bets.

  6. I don't drink alcohol, never have. And I don't understand why people are so attracted to it. Further, I'm really opposed to drunk drivers. But it is far more hazardous to society to have police that refuse to submit to the authority of the Rule of Law.

    What about the 5th amendment? Why can't the police just recognize that they need to submit to the authority of the United States Constitution?
