  1. This is very iffy and there is a high likelihood that a judge would find no probable cause. The cop walked up and asked if the person would step out. To any reasonable person that was a consensual encounter being established, not a lawful one. Furthermore, even if the officer had received a call about them camping in their van, that's not inherently illegal. They could potentially be cited for parking longer than allowed on a posted zone, but even then the officer would have to give the person a warning and opportunity to leave to remedy to the violation. Not to mention this wasn't a traffic stop, so the officers authority to order someone out of their vehicle likely didn't exist and probably why the officer asked instead of demanded despite acting like it was a demand. If this person get's a remotely knowledgeable defense attorney or judge this case will be dismissed.

If the police smell or see Marijuana… they don't need your consent to search the vehicle.. the smell alone gives them enough probable cause.. hell, a roach is enough…I've never understood why people smoke in their car?😂😂😂.. especially when they're riding dirty.. I seen a video of a guy that had kilos hidden in his car… but he was transporting in a car that had a busted tail light, bad tag, suspended license….AND the car smelled like weed cause he was smoking.. he was the most brainless drug smuggler I've ever seen on bodycam😂😂😂

  3. I've been stopped quite a few times by police for things that didn't involve me and a few times for something like this. I listened to the police and I was back on my way 15-minutes later.

  4. For those who do not know once you have committed a crime, especially in a vehicle they do not need a warrant to search your vehicle. It’s called inventory. It’s basically loophole because they have to tow the vehicle. They have to search it so it’s legal.

  5. You’re under arrest, your car smells like marijuana and your van is being towed, it’s being searched for the weed and everything itemized for the tow, they don’t need your consent

  6. Female cop needs to be investigated, she's searching the vehicle like she got a tip, and without a warrant going through one of their phones , probably deleting the video the girl was recording of her
