  1. "Not everyone is educated on this stuff"
    Police should be, not just 1/3 cops but every cop. It's simple, it has been established for more than 40 years that you can record in public

  2. Remember the Info at the front of the video … This was not just a 1st Amendment Audit .. Mr. Livingston was looking for the mistreatment of the homeless population by the local PD. So, if anything here… the PD is guilty of Stalking or Harassment … it does appear to be a pattern of behavior.

  3. The officer was simply being lazy and was sleep walking through his job. Conducted absolutely no investigation before conduction an unlawful detainment and demanding ID. An investigation should begin with collecting the facts, not with detainments and ID that implicate the 4th amendment.

  4. Clowns from the get go…can't believe not one of these clowns couldn't see what was wrong here…or maybe they just didn't want to see over the blue line.

  5. The street more than likely has video cameras. The restaurant more than likely has audio video recording. The idea that one guy with a camera on the sidewalk is violating their rights is ridiculous.

  6. Dude, you’re such a hypocrite. You say the car bad, reasonable suspicion and then say the call came in as the guy being on the sidewalk come on, dude.

Under the officers logic, I would have then said I want every customer and worker in the Jolly Pumpkin trespassed from my private property (my home) and then make the cops ask everyone for their IDs and write the trespass warnings. Doesn’t matter if they don’t know where I live or have never been to my home, since it doesn’t matter to the cops.

  8. This involves contradictory Rights: Freedom of assembly and free from unreasonable searches or seizures without warrant with particulars. Filming public servants is protected, but technology takes casual observation or contact to search. So recording patrons of a restaurant patio vs police denying homeless access to public space are different. The failure to make this distinction is a great failure of this site.

  9. Typical frauditor….harassing regular people to provoke a reaction from them. No LOLsuit for this frauditor, as usual. 😂😂😂😂

  10. The cop who just casually walked over and check the guys bag shown that violating people rights is second nature to these cops. People only have the rights cops say they do…the only way cops find out about a citizen rights is after they violate them and the city or dept is sued….they are told to stop doing that

  11. The stupidity of the police never suprises me any more. It's amazing how ignorant of the law they really are, and the sergeant are not bothered about it, they do not stop and educate their officers, they just let them carry on breaking the law they are sworn in to uphold. Madness!
