  1. How is this case still going on? Smith v Cumming was decided in 2000, NINE YEARS prior to this incident.
    "As to the First Amendment claim under Section 1983, we agree with the Smiths that they had a First Amendment right, subject to reasonable time, manner and place restrictions, to photograph or videotape police conduct.   The First Amendment protects the right to gather information about what public officials do on public property, and specifically, a right to record matters of public interest.
    "… Thus, the district court erred in concluding that there was no First Amendment right."
    How then can this COP say "In Florida, it is illegal for you to audio record me. I don't care if you take pictures, but you can't record my voice."

This goes to show how stupid police are .. the one thing they swear to that gets them a job they forget immediately ….how dumb can you be to see poor police training up and down the chain of command…auditors now see that this department need a massive audit…I hope she says them easy one…you can see the first amendment means nothing to idiots…of the chief of police sees and hears nothing wrong in this whole encounter then he needs to be replaced…the I'd eww a that anything a police says means you must do illegal or unconstitutional it matters not…govt employees who forget who they work for

  9. Please call and let them know how you feel about them violating the Constitution. We have to stand up for our rights and those violated 100%. This is absolute bullshit.

  10. This case should be still ongoing and someone also needs to push for the judge to be stood down from the bar. Basically stems from a 1st amendment violation and the constitution states judges must lean in favor of the citizen whose rights were violated.
