In order for a DUI checkpoint to comply with California law there must be a legal way for motorists to avoid the checkpoint AFTER notice of the checkpoint has been given.
Turning to avoid the checkpoint does NOT give police probable cause to make a traffic stop. However, many police departments still routinely stop cars simply for LEGALLY avoiding the checkpoint.
